Terms of service
1. Who we are
www.awatara.gr is operated by AWATARA IKE (private company), General Commercial Registry (G.E.MI.) no. 142793958000, VAT no. EL800844794, email info@awatara.gr. Our stores: Lisiou 18, Plaka, 10556 Athens (tel. +30 210 3250231) and Potie 54, 73132 Chania, Crete (tel. +30 28216 01945).
2. Scope
These Terms of Sale apply to orders placed on www.awatara.gr. Where you buy as a consumer, mandatory consumer protection rules always prevail over these terms.
3. Products and information
We describe our products as accurately as possible, including their materials and composition. Colours may vary slightly depending on your screen. This does not limit your rights under the legal guarantee of conformity.
4. Prices
Prices are in euro and include VAT where applicable. Delivery costs are shown at checkout before you place your order. For deliveries outside the EU, import duties and taxes are not included and are payable by the recipient to the carrier or customs authority.
5. How the contract is formed
The product pages are an invitation to order. When you click the final order button at checkout, you place a binding order with an obligation to pay. The contract is concluded when our "Order confirmation" email reaches you at the email address you gave at checkout. This email confirms both that we have received your order and that we accept it. If you do not receive it within 24 hours, please check your spam folder or contact us at info@awatara.gr.
The "Order confirmation" email contains your order details. These Terms of Sale and our other policies remain available on our website, where you can store and print them.
6. Obvious pricing errors
We do not change the price of an accepted order, or cancel it, automatically. If a product was shown at an obviously incorrect price because of a manifest technical or typing error, we will contact you as soon as we notice it to agree a solution with you, for example keeping the order at the correct price or cancelling it with a full refund of all amounts paid. Your statutory rights are not affected.
7. Payment
You can pay with the payment methods shown at checkout, such as card payments through Shopify Payments, PayPal, Shop Pay, Apple Pay and Google Pay. Card and wallet payments are charged when you place your order. Cash on delivery is available only for delivery addresses in Greece.
8. Delivery
Delivery options, costs and estimated delivery times are shown at checkout and described in our Shipping Policy. We deliver within the time indicated and in any case within 30 days of the conclusion of the contract, unless agreed otherwise. If we do not deliver within the agreed time, you may set an additional reasonable period; if we still do not deliver within that period, you may terminate the contract and receive a full refund. The risk of loss or damage passes to you when you, or a third party you have designated (other than the carrier), acquire physical possession of the goods; for parcel lockers, when the parcel is collected from the locker.
9. Right of withdrawal
As a consumer you have a 14-day right of withdrawal, as described in our Returns & Right of Withdrawal policy, which forms part of these terms. You can withdraw online here: Click here to withdraw.
10. Legal guarantee
All products are covered by the legal guarantee of conformity for 2 years from delivery. Details are in section 9 of our Returns & Right of Withdrawal policy.
11. Liability
We are liable in accordance with the law. Nothing in these terms excludes or limits our liability for intent or gross negligence, for death or personal injury, or any other liability that cannot be excluded or limited under applicable law.
12. Personal data
We process your personal data as described in our Privacy Policy.
13. Intellectual property
The content of the website (texts, photographs, designs, logos) belongs to AWATARA IKE or its licensors and may not be used without our permission.
14. Applicable law
These terms are governed by Greek law. If you are a consumer living in another country, you also keep the protection of the mandatory provisions of the law of your country of residence.
15. Complaints and disputes
Please contact us first at info@awatara.gr. You may also turn to the Hellenic Consumer Ombudsman (www.synigoroskatanaloti.gr) or, if you live in another EU country, to the European Consumer Centres Network (ECC-Net). Consumers may bring proceedings before the courts of their place of residence or before the competent Greek courts.
16. Changes
We may update these terms. The version in force when you place your order applies to that order.
